Elements of Education Privacy Policy

Collection, Use and Security of Personal Information:
The Elements of Education Partners values and respects an individual’s right to keep certain Personal Information private. Likewise, the EOE PARTNERS values the need to collect and use Personal Information which will enable the EOE PARTNERS to effectively deliver products and services leading to the support of the students of the school we support. This Privacy Policy applies to activities of the EOE PARTNERS and additionally to persons visiting EOE PARTNERS Web sites, signing up for EOE PARTNERS publications and mailings, or entering into transactions with the EOE, and covers the collection, use, storage and disclosure of information and data as described in this Privacy Policy. The Privacy Policy does not apply to information that the EOE PARTNERS collects on contractors, vendors or other entities with which the EOE PARTNERS does business, although the EOE PARTNERS will contractually require them to comply with relevant provisions of the Privacy Policy.

EOE PARTNERS Collection of Personal Information:
1. The EOE PARTNERS will collect Personal Information on an individual only if the individual provides the information to the EOE Partners. The EOE PARTNERS also may collect information about a person who has been referred to the website to send them emails regarding EOE’s efforts or a person to whom the EOE PARTNERS has been asked to send emails regarding EOE’s programs or efforts. If a person donates to the EOE Partners, the EOE PARTNERS may collect sensitive Personal Information such as the donor’s credit card number, card type, and expiration date and keep a record of the financial transaction.
2. The EOE PARTNERS may collect Demographic Information it obtains from individuals and third parties for fund raising purposes and to notify persons of EOE PARTNERS programs, events, educational opportunities and upcoming meetings.
3. The EOE PARTNERS may collect Aggregate and Transactional Information and add to its database every time a person visits an EOE PARTNERS Web Site. Also, the EOE PARTNERS collects Aggregate Information for research purposes.

EOE PARTNERS Use of Personal Information:
1. When an individual provides Personal Information to the EOE, the EOE PARTNERS may use the Personal Information for its programs, research and fund raising.
2. The EOE PARTNERS uses Transactional Information for research purposes for the development or implementation of its programs, products and services. The presumption is that, since Transactional Information is highly proprietary, it will not be disclosed to third parties.
3. The EOE PARTNERS will disclose all information as required by law.
4. The EOE PARTNERS will make every effort to discontinue the use of an individual’s Personal Information as soon as practicable if requested by that individual. The EOE PARTNERS may need to retain Information in its archives and records to comply with law, resolve disputes, analyze problems, assist with any investigations, enforce EOE’s User Agreement and other policies, and take other actions otherwise permitted or required by law.

Specific Requirements:
1. Administrative:
The EOE PARTNERS will take reasonable and appropriate measures to keep Personal Information confidential and in a secure environment, including taking appropriate action in the event of unauthorized disclosure.
Access to Personal Information will be restricted to only those personnel with a legitimate business purpose.
The EOE PARTNERS owns all Personal Information provided to it by individuals and collected in accordance with this Policy. When an individual provides Information to the EOE, the EOE PARTNERS will ensure that the individual acknowledges their assignment of the right to use the data to the EOE.

2.Third Party Disclosure
Permission is required before the EOE PARTNERS discloses Personal Information to a third party. No permission is necessary for Aggregate Information, since Aggregate Information does not identify a specific individual.
For disclosure of Demographic Information (e.g., rentals or exchanges of donor lists), the EOE PARTNERS as a minimum will use the “Opt Out” approach. An “opt-out” is obtained when the EOE PARTNERS through some correspondence gives an individual the opportunity to decline or “opt-out” of disclosures to third parties. If the individual does not opt out, permission is deemed granted. Depending upon the nature of an activity or project, a higher standard than “opt-out” may be used, such as “opt-in” whereby an individual must affirmatively give consent before information is disclosed.
From time to time, there is a benefit in allowing a third party to use collected Personal Information on individuals. However, unless an individual gives permission, the EOE PARTNERS will not disclose Personal Information collected by the EOE PARTNERS to any third party. The EOE PARTNERS sometimes engages third parties to provide certain operational services to the EOE PARTNERS or on its behalf. The EOE PARTNERS may disclose Personal Information to those third parties on a “need to know” basis under a written contract.
The EOE PARTNERS uses and allows third parties to use Aggregate Information for research purposes for the development or implementation of its programs, products and services.

This Privacy Policy (this “Privacy Policy”) describes Trail Software’s (d/b/a Kindful) (“Trail Software”, “Kindful,” “we,” “us,” or” “our”) collection, use, and disclosure of “personal information” that may be collected by Kindful anytime you (“you” or “user”) visit our website, [https://www.kindful.com] (this “Site”). “Personal information” means information about an identifiable individual who can be directly or indirectly identified, which does not include information of an aggregate or anonymous nature where a specific individual or individuals cannot be identified.

BY SUBMITTING YOUR INFORMATION THROUGH THIS SITE, YOU CONSENT TO THIS PRIVACY POLICY AND TO KINDFUL’S) COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION ACCORDING TO THE TERMS OF THIS PRIVACY POLICY. THIS SITE IS A GENERAL AUDIENCE SITE AND DOES NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER 13 YEARS OF AGE. Information we collect and how we may use it

If you are a customer of Kindful, we collect certain information about you in order to provide you with our donor management system and/or online payment service (the “Service”). When you register for the Service we will request some personal information such as your name and email address, and information about your organization such as the name of your organization, Tax ID, mailing address, and tax designation. Furthermore, if you are opening a merchant account, Kindful may also obtain information about you from third party sources, including, without limitation, consumer reporting agencies. This information is used to contact you about the services on our Site for which you have expressed an interest. As part of the Service, we may also collect donor information on behalf of your organization. Except as may be expressly set forth herein, we will not use any donor information collected on your behalf for any purpose other than to provide the Service. Any tax or financial information we collect is used only to bill you for the Service. If you purchase the Service by credit card, this information will be transmitted to our credit card merchant account provider, and may be forwarded to your credit card provider. We do not store credit card information.

If you are a donor for a Kindful customer, we collect certain information from you in order to process your donation (“Donor Information”). Kindful will use Donor Information during the course of providing the Service to such Kindful customer. Kindful may also use Donor Information at an aggregate level for internal business analyses and fraud prevention. During the course of providing the Service to Kindful customers, Kindful may disclose Donor Information to banks, processors, card associations, and other financial institutions that are involved in the course of processing or screening the transaction applicable to the Donor Information.

We may use personal information for internal purposes to provide you with other products and services, or to contact you regarding administrative notices or communications relevant to you on this Site. In addition, we may use personal information to provide or improve products or services that you have requested.

Please note that personal information does not include “aggregate” information, which is data we collect about a group or category of users, from which individual identities or other personal information has been removed. This Privacy Policy in no way restricts or limits our collection, use, or our ability to sell such aggregate information.

Additional Limits on Use of Google User Data: Notwithstanding anything else in this Privacy Policy, the following types of your Google data will be subject to these additional restrictions:

  • We will only use access to read Gmail message bodies (including attachments), metadata, headers, and settings to display emails to authorized users of Kindful and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.

  • We will not use this Gmail data for serving advertisements.

  • We will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for our internal operations and even then only when the data have been aggregated and anonymized.

When we disclose your information

Kindful takes your privacy very seriously. The information we collect is used to provide the Service, and, in general, is not shared with or sold to other organizations for commercial purposes. However, there are times when it may be advantageous for Kindful to make certain personal information about you available to companies that Kindful has a strategic relationship with or that perform work for Kindful to provide products and services to you on our behalf. These companies may help us process information, deliver products or services to you, provide customer service, manage and enhance user data, assess your interest in our products and services, or conduct user research or satisfaction surveys. We may also disclose your personal information, if you have authorized us to act on your behalf to initiate the creation of a merchant account for the purpose of accepting donations by credit card.

Alternatively, the law provides that if the company has a privacy policy that gives either an Opt-out or Opt-in choice for use of your personal information by third parties (such as advertisers) for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options.

Kindful qualifies for the alternative option; it has a comprehensive privacy policy and provides you with details on how you may either Opt-out or Opt-in to the use of your personal information by third parties for direct marketing purposes. Therefore, we are not required to maintain or disclose a list of the third parties that received your personal information for marketing purposes during the preceding year.
